The role of mediator is most effective if disputed parties are brought together as soon as possible and resolution will be more easily achieved, but sometimes I come late to the proceedings, when relationships are fraught and parties can’t see a way forward.
As a trained mediator, my position is neutral. My role is to cut through emotion and identify the issue, to assist the parties with respect and empathy, to provide alternatives and resolution options that will help them to resolve the dispute themselves. This is a very cost effective alternative to lengthy and expensive legal action.
New legislation in 2019 now requires banks and other secured creditors to offer mediation to farmers before any debt enforcement action. I am one of 14 assigned mediators, throughout the country, working under the Farm Debt Management Scheme.
Mediation calls for excellent communication skills dealing with clients, lawyers, other parties, judicial and other decision-makers. I have a successful record in a wide range of mediations including farm succession, disputes between local authorities and landowners, and business takeovers.
